Ailes has issued a denial, saying Carlson was retaliating because her contract was not being renewed, and Fox is conducting an internal investigation of the allegations.<\/p>\n<p>The news caught my attention because I\u2019ve had a handful of female friends who\u2019ve faced sexual harassment from bosses. One was even brave enough to suck up the courage and sue. She won \u2014 if you can call it that \u2014 and received a sizeable financial remuneration, but was terminated from her job and the entire process was humiliating. Moreover, in her opinion, the suit took a huge toll on her and, she has always felt, set her back professionally.<\/p>\n<p>Sexual harassment in the workplace is deep-seated.<\/p>\n<p class=\"pull-quote\">A <a href=\"http:\/\/www.cosmopolitan.com\/career\/news\/a36453\/cosmopolitan-sexual-harassment-survey\/\" target=\"_blank\">2015 Cosmopolitan survey<\/a> found that about one in three women report that they\u2019ve been sexually harassed in the workplace. Like Carlson\u2019s complaint, 38 percent said the harassment came from a male boss. More than 70 percent, however, did not report their abuse.<\/p>\n<p class=\"pull-quote\"><strong>(Read article on <a href=\"http:\/\/www.forbes.com\/sites\/nextavenue\/2016\/07\/13\/what-to-do-if-youre-being-sexually-harassed-at-work\/#644f80ad2af6\">Forbes<\/a>)<\/strong><\/p>\n<p>If you\u2019re a woman (or a man) who believes you are being, or have been, sexually harassed at work, what should you do? For advice, I turned to <a href=\"http:\/\/www.nextavenue.org\/am-i-being-targeted-layoff-due-my-age\/\">Donna Ballman<\/a>, a respected employment lawyer and author of <a href=\"https:\/\/www.amazon.com\/Stand-Yourself-Without-Getting-Fired\/dp\/1601632355\/185-8493609-1900556?ie=UTF8&amp;*Version*=1&amp;*entries*=0\"><em>Stand Up for Yourself Without Getting Fired<\/em>.<\/a><\/p>\n<figure class=\"wp-caption alignleft\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-131041\" src=\"https:\/\/i0.wp.com\/www.nextavenue.org\/wp-content\/uploads\/2016\/07\/Donna-Ballman-Portrait-Embed.jpg?resize=100%2C110&#038;ssl=1\" alt=\"Donna Ballman\" width=\"100\" height=\"110\" \/><figcaption class=\"wp-caption-text\">Donna Ballman<\/figcaption><\/figure>\n<p>\u201cIt\u2019s extremely hard to prove and win a sexual harassment claim,\u201d Ballman told me. \u201cCarlson claims she was retaliated against. In my 30 years of experience representing employees, I\u2019ve found that retaliation seems to be the norm, rather than the exception, when it comes to sexual harassment.\u201d<\/p>\n<p>The data bear that out. According to the <a href=\"https:\/\/www.eeoc.gov\/eeoc\/statistics\/enforcement\/charges.cfm\" target=\"_blank\">Equal Employment Opportunity Commission <\/a>(EEOC), charges of retaliation linked to discrimination claims more than doubled from 1997 to 2015, to just under 40,000, overtaking charges of racial discrimination.<\/p>\n<p>That said, Ballman continued: \u201cWomen (and men) are justifiably afraid to report sexual harassment. Still, as you see from the Carlson case, sexual harassment is <em>not<\/em> about sex. It\u2019s about <em>power<\/em>. If you don\u2019t speak up about a sexual harasser, he or she will keep doing it and accelerate their behavior.\u201d<\/p>\n<h3>8 Steps to Take<\/h3>\n<p>Here\u2019s Ballman with her eight steps to take if you believe you\u2019re the victim of sexual harassment at work:<\/p>\n<p><strong>1. Document any\u00a0quid pro quo.<\/strong> One type of sexual harassment, called\u00a0\u201cquid pro quo\u00a0sexual harassment,\u201d is where you\u2019re offered a job, promotion or favors if you submit to the harasser \u2014 or are threatened that you\u2019ll be demoted, fired or disciplined if you don\u2019t. So if any offers or threats are being made, write down the date, time, place and any witnesses.<\/p>\n<p>Don\u2019t worry if there are no witnesses. Harassers are usually too smart to do it in front of others.<\/p>\n<p><strong>2. Document any comments and different treatment you\u2019ve received. <\/strong>The other type of sexual harassment, called \u201chostile environment,\u201d is way more common than quid pro quo. Hostile environment is where you\u2019re being harassed due to your gender. This could be comments about your gender being inferior, sexual comments or treating people of your gender differently than the opposite sex.<\/p>\n<p>If the harasser is making comments or treating you differently, he or she may also be targeting others of your sex. Watch carefully and take good notes of comments directed to you and to others. Again, include date, time, place and any witnesses. If it\u2019s just you, then still document it.<\/p>\n<p>Carlson\u2019s suit is a combination of quid pro quo and hostile environment harassment.<\/p>\n<p><strong>3. Keep your notes in a safe place.<\/strong> Don\u2019t put them on your work computer, in a desk drawer or somewhere where your employer can take them. Instead, keep them in a purse or briefcase or write them on your home computer. If you\u2019re fired, you\u2019ll be prevented from taking your notes from your work computer and they may be conveniently \u201clost.\u201d<\/p>\n<p><strong>4. Gather your evidence.<\/strong> If the harasser is texting, emailing or sending cards or notes, keep copies. Don\u2019t delete them. Make sure you take a screen shot of any texts or Snapchats and print them so you don\u2019t lose them if your device crashes or you buy a new one. Print out emails, too, and keep them in a safe place.<\/p>\n<p><strong>5. Report the harassment at work.<\/strong> The Supreme Court says that reporting sexual harassment is a requirement before you can sue. You have to give the employer a chance to correct the situation. Make sure you\u2019ve followed the company sexual harassment policy, if there is one, and reported your concern to the correct person. The employer should have alternate people to report it to in case one is your harasser.<\/p>\n<p>I suggest reporting it in writing. If you\u2019ve only reported it verbally, follow up in writing. Write something like, \u2018This will confirm our conversation on June 15, 2016 in which I reported sexual harassment by my supervisor Jeff Roe. I reported the following instances of sexual harassment to you: [list them]. Please take prompt action to investigate this matter and address this situation.\u2019<\/p>\n<p>Remember, the employer doesn\u2019t have to fire the harasser or tell you what action was taken. They only have to make it stop. If he or she does it again or retaliates, report it. Once the company is on notice that a person is a harasser, it will be strictly liable if they don\u2019t stop him or her.<\/p>\n<p><strong>6. File a complaint with the EEOC.<\/strong> If you\u2019ve already reported harassment at work and the employer won\u2019t take action, <a href=\"https:\/\/www.eeoc.gov\/federal\/fed_employees\/filing_complaint.cfm\" target=\"_blank\">filing with the Equal Employment Opportunity Commission<\/a> is the next step. Depending on your state, you have 180 or 300 days from the date of discrimination to file. You are protected from retaliation if you file a charge of discrimination with the EEOC.<\/p>\n<p>That isn\u2019t to say the employer won\u2019t still retaliate, but if it does, you can report the retaliation to EEOC and possibly sue.<\/p>\n<p>Fox News has said Carlson must pursue a confidential arbitration proceeding rather than a lawsuit (and Fox may get away with this if it\u2019s in her contract). But an employer can\u2019t stop you from filing with the EEOC, even if you have an arbitration clause.<\/p>\n<p><strong>7.<\/strong> <strong>Find a good lawyer<\/strong>. I\u2019d suggest contacting an\u00a0<a href=\"http:\/\/exchange.nela.org\/network\/findalawyer\" target=\"_blank\">employment lawyer <\/a>in your state\u00a0to see if you can get someone who understands sexual harassment. It is frequently your word against the harasser\u2019s, so you\u2019ll want someone to bolster your case.<\/p>\n<p><strong>8. Get the heck out.<\/strong> If your company won\u2019t do anything and you don\u2019t feel safe there, start looking for a position elsewhere. Don\u2019t let the harasser bully you out of a job before you\u2019re ready, but don\u2019t feel trapped either.<\/p>\n<p>Sometimes a sexual harasser will work on your head and make you feel like nobody else would want you. Don\u2019t believe it. You\u2019ll be amazed how relieved you\u2019ll be to get out of a bad situation.<\/p>\n<p>One last thing: If you don\u2019t report sexual harassment, there will be other victims and the behavior will get worse. Stand up for your right to a safe workplace. Your employer has a duty to keep your workplace free of sexual harassment.
