In 1954, the two companies merged, but the new company lost its traction and US production came to a screeching halt in 1963. When the company went kaput, thousands of the company\u2019s workers discovered that their traditional defined benefit pensions guaranteeing an income stream for life were terminated too.<\/p>\n<p class=\"yf-1090901\"><span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">The outrage caught the attention of lawmakers, and although it took more than a decade, federal legislation to protect workers\u2019 retirement savings was signed into law in 1974: the Employee Retirement Income Security Act, or ERISA.<\/span><\/p>\n<p class=\"yf-1090901\">That law is the spine of much of today\u2019s retirement benefit landscape for American workers, but it&#8217;s having a midlife crisis.<\/p>\n<p><em><strong><a href=\"https:\/\/finance.yahoo.com\/news\/how-a-50-year-old-law-changed-retirement-and-why-it-needs-a-facelift-153048491.html\">Read on Yahoo Finance<\/a><\/strong><\/em><\/p>\n<p class=\"yf-1090901\">The gist of it: ERISA was created to protect workers by overseeing retirement accounts like traditional pension plans and, eventually, 401(k) and most 403(b) plans, but it only safeguards some of us.<\/p>\n<p class=\"yf-1090901\">In a special episode of<a class=\"link yahoo-link\" href=\"https:\/\/finance.yahoo.com\/video\/erisa-turns-50-one-law-170046708.html\" data-i13n=\"cpos:1;pos:1\" data-ylk=\"slk:Decoding Retirement;cpos:1;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" data-rapid_p=\"10\" data-v9y=\"1\">\u00a0<em>Decoding Retirement<\/em><\/a><em>,<\/em>\u00a0I sat down with Robert Powell, a retirement expert and host of the podcast; and Molly Moorhead, Yahoo Finance\u2019s personal finance editor, to discuss how American workers are faring under ERISA.<\/p>\n<figure class=\"wp-block-embed wp-block-embed-youtube is-type-video is-provider-youtube epyt-figure\"><div class=\"wp-block-embed__wrapper\"><iframe loading=\"lazy\"  id=\"_ytid_59373\"  width=\"640\" height=\"360\"  data-origwidth=\"640\" data-origheight=\"360\" src=\"https:\/\/www.youtube.com\/embed\/Six_1QNRStI?enablejsapi=1&autoplay=0&cc_load_policy=0&cc_lang_pref=&iv_load_policy=1&loop=0&rel=1&fs=1&playsinline=0&autohide=2&theme=dark&color=red&controls=1&\" class=\"__youtube_prefs__  no-lazyload\" title=\"YouTube player\"  allow=\"fullscreen; accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen data-no-lazy=\"1\" data-skipgform_ajax_framebjll=\"\"><\/iframe><\/div><\/figure>\n<h2 id=\"the-wins-of-erisa\" class=\"header-scroll yf-gn6wdt\"><strong>The wins of ERISA<\/strong><\/h2>\n<p class=\"yf-1090901\">ERISA fortified retirement savings to a more stable system, ensuring that plan participants receive their benefits and that the Studebaker-Packard pension collapse doesn&#8217;t happen again.<\/p>\n<p class=\"yf-1090901\">The law imposes funding requirements for companies, rules for employee eligibility, and fiduciary standards requiring employer plan sponsors to act solely in the interest of participants. In 1970, more than half of full-time workers were covered by a traditional pension, according to the US\u00a0<a class=\"link \" href=\"https:\/\/www.bls.gov\/opub\/mlr\/2006\/03\/art4full.pdf\" target=\"_blank\" rel=\"nofollow noopener\" data-i13n=\"cpos:3;pos:1\" data-ylk=\"slk:Bureau of Labor Statistics;cpos:3;pos:1;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"13\" data-v9y=\"1\">Bureau of Labor Statistics<\/a>. Today, just 11% of private employees participate in traditional, or defined-benefit, pensions, compared with around 35% in the early &#8217;90s.<\/p>\n<p class=\"yf-1090901\">Moreover, many small-business owners contend offering a retirement plan to employees is simply too costly and complicated to manage under the law.<\/p>\n<h2 id=\"what-has-changed-since-the-law-was-enacted\" class=\"header-scroll yf-gn6wdt\"><strong>What has changed since the law was enacted<\/strong><\/h2>\n<p class=\"yf-1090901\">ERISA turned 50 in September. The job market, the state of the middle class, and the nature of work have all evolved in that half-century. Here are some factors that ERISA doesn\u2019t account for:<\/p>\n<p class=\"yf-1090901\"><strong>The rise of IRAs.\u00a0<\/strong>Five decades since the law was created, it only applies to about half of private-sector US workers \u2014 those who are covered by an employer retirement plan.<\/p>\n<p class=\"yf-1090901\">The rest either work for a small business that doesn\u2019t have a plan or are contract workers. Only one-third of employees at small businesses have access to an employer-sponsored retirement plan, according to the\u00a0<a class=\"link \" href=\"https:\/\/bipartisanpolicy.org\/blog\/retirement-startup-tax-credits\/#:~:text=Substantial%20Credits%20for%20Small%20Businesses,educating%20employees%20about%20the%20plan.&amp;text=The%20lesser%20of:,$5%2C000.\" target=\"_blank\" rel=\"nofollow noopener\" data-i13n=\"cpos:4;pos:1\" data-ylk=\"slk:Bipartisan Policy Center;cpos:4;pos:1;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"14\" data-v9y=\"1\">Bipartisan Policy Center<\/a>. <span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">The number of gig workers, contractors, and freelancers has also blown up. If you have earned income, you can save for retirement in a tax-advantaged saving option, like an Individual Retirement Account (IRA).<\/span><\/p>\n<p class=\"yf-1090901\"><span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">But ERISA doesn\u2019t apply to IRAs, because they didn\u2019t exist when it was enacted. \u201cBecause there\u2019s no fiduciary rule on these accounts, that potentially exposes participants, especially seniors, to financial exploitation during rollovers,\u201d Powell said.<\/span><\/p>\n<p class=\"yf-1090901\"><strong>Longer lives.\u00a0<\/strong>Lifespans have increased by around a decade since the 1960s, putting even more pressure on people to save. The number of Americans 65 and older is projected to increase from 58 million in 2022 to 82 million by 2050, and the 65-and-older age group\u2019s share of the total population is projected to rise from 17% to 23%, according to the\u00a0<a class=\"link \" href=\"https:\/\/www.census.gov\/data\/tables\/2023\/demo\/popproj\/2023-summary-tables.html\" target=\"_blank\" rel=\"nofollow noopener\" data-i13n=\"cpos:5;pos:1\" data-ylk=\"slk:US Census Bureau;cpos:5;pos:1;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"15\" data-v9y=\"1\">US Census Bureau<\/a>.<\/p>\n<p class=\"yf-1090901\">\u201cBased on our research, over 40% of all US households might expect to run out of money in retirement,\u201d Surya Kolluri, head of the\u00a0<a class=\"link \" href=\"https:\/\/www.tiaa.org\/public\/institute\" target=\"_blank\" rel=\"nofollow noopener\" data-i13n=\"cpos:6;pos:1\" data-ylk=\"slk:TIAA Institute;cpos:6;pos:1;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"16\" data-v9y=\"1\">TIAA Institute<\/a>, told Yahoo Finance.<\/p>\n<p><span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">Translation: <\/span><a class=\"link yahoo-link\" style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\" href=\"https:\/\/finance.yahoo.com\/news\/retirement-in-america-is-a-disaster-for-many-is-there-hope-130053770.html\" data-i13n=\"cpos:7;pos:1\" data-ylk=\"slk:More workers need access to retirement plans;cpos:7;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" data-rapid_p=\"17\" data-v9y=\"1\">More workers need access to retirement plans<\/a><span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">, and ideally, ones that offer the gutter bumpers provided by ERISA.<\/span><\/p>\n<p class=\"yf-1090901\"><strong>Job hopping.\u00a0<\/strong>This wasn\u2019t really a thing back in the early 60s, but it sure is today. Last year, the median number of years that wage and salary workers had been with their current employer was 3.9 years, the<a class=\"link \" href=\"https:\/\/www.bls.gov\/news.release\/pdf\/tenure.pdf\" target=\"_blank\" rel=\"nofollow noopener\" data-i13n=\"cpos:8;pos:1\" data-ylk=\"slk:lowest;cpos:8;pos:1;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"18\" data-v9y=\"1\">\u00a0lowest\u00a0<\/a>since 2002, according to the US Bureau of Labor Statistics.<\/p>\n<p class=\"yf-1090901\">That can be a problem when it comes to saving for retirement. A typical worker sees a 10% increase in income when switching employers but a one percentage point decline in their retirement saving rate, according to\u00a0<a class=\"link \" href=\"https:\/\/corporate.vanguard.com\/content\/dam\/corp\/research\/pdf\/job_transitions_slow_retirement_savings.pdf\" target=\"_blank\" rel=\"nofollow noopener\" data-i13n=\"cpos:9;pos:1\" data-ylk=\"slk:Vanguard research;cpos:9;pos:1;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"19\" data-v9y=\"1\">Vanguard research<\/a>.<\/p>\n<p class=\"yf-1090901\">And when an employer does not offer automatic enrollment in its retirement plan, 1 in 4 new hires stop saving for retirement altogether. IRAs hold around $15.2 trillion in assets compared to approximately $8.9 trillion in 401(k) plans, according to the\u00a0<a class=\"link \" href=\"https:\/\/www.ici.org\/401k#:~:text=Savings%20rolled%20over%20from%20401,as%20of%20September%2030%2C%202024.\" target=\"_blank\" rel=\"nofollow noopener\" data-i13n=\"cpos:10;pos:1\" data-ylk=\"slk:Investment Company Institute;cpos:10;pos:1;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"20\" data-v9y=\"1\">Investment Company Institute<\/a>. Savings rolled over from 401(k)s and other employer-sponsored retirement plans account for about half of IRA assets.<\/p>\n<p class=\"yf-1090901\">Nearly two-dozen<a class=\"link \" href=\"https:\/\/cri.georgetown.edu\/states\/\" target=\"_blank\" rel=\"nofollow noopener\" data-i13n=\"cpos:11;pos:1\" data-ylk=\"slk:states have;cpos:11;pos:1;elm:context_link;itc:0;sec:content-canvas\" data-rapid_p=\"21\" data-v9y=\"1\">\u00a0states have<\/a> enacted new programs for private sector workers, and 17 are auto-IRA programs. They require most private employers that don\u2019t sponsor a savings plan to enroll workers in a state-facilitated IRA at a preset savings rate \u2014 usually 3% to 5% \u2014 which is automatically deducted from paychecks.
